Distance Sales Agreement

This is the English version of the agreement for orders paid in Türkiye through iyzico. It is made electronically between the Seller below and the Buyer who orders ByPilot online, under Turkish Consumer Protection Law No. 6502, the Regulation on Distance Contracts and the Turkish Code of Obligations. Orders paid outside Türkiye go through Paddle.com, our Merchant of Record, and Paddle's buyer terms apply to the sale; our Terms of Service apply to the use of the service in both cases.

Buyer: the person or company whose name, address and email are recorded at checkout. The Buyer's details appear on the order and the invoice.

2. Subject

The subject is the right to use the chosen ByPilot plan (Starter, Growth or Pro), add-ons or credit packs as a cloud service. The service is digital and provided immediately online; nothing is shipped. Plan contents and prices are those shown on the Pricing page at the time of the order.

3. Price and payment

• The price is the amount before VAT shown on the order plus 20% VAT. Payment is made by card through iyzico.
• An electronic invoice (e-Arşiv) is sent to the Buyer's email address.
• With the Buyer's consent the card is stored by iyzico; the Seller never sees or stores the card number.

4. Subscription, automatic renewal and cancellation

• The subscription renews automatically for the same period (monthly or annual) at the end of each period, and the renewal is charged to the stored card. The Buyer is told by email before each renewal.
• The Buyer can cancel at any time in Settings > Plan. Cancellation takes effect at the end of the current period; the service stays available until then.
• If a payment fails, the Seller notifies the Buyer and allows a reasonable time to pay. If no payment is made, the service may be suspended.

5. Right of withdrawal

• A consumer Buyer has a right of withdrawal for 14 days from the date of the agreement, without giving a reason. Notice is sent in writing to support@bypilot.ai; the amount is refunded to the card within 14 days.
• Under Article 15 of the Regulation on Distance Contracts, the right of withdrawal does not apply to digital content and services whose performance starts immediately with the Buyer's consent. Credit packs are available as soon as they are bought and are therefore not covered. The Buyer confirms at checkout that they were told this.
• Buyers acting for business or professional purposes have no statutory right of withdrawal; the Refund Policy applies to them.

6. Rights and duties

• The Seller provides the service under the Terms of Service with reasonable care.
• The Buyer keeps the account secure and uses the service lawfully and under the Terms of Service.
• The Seller may change prices, plan contents and features as set out in the Terms of Service. Price changes are announced at least 30 days in advance; annual plans keep their price until the end of the period.
• The Seller may suspend the account or terminate the agreement for non-payment, misuse or breach of the Terms of Service.

7. Disputes

A consumer Buyer may apply to the Consumer Arbitration Committee of their place of residence or of the transaction, within the monetary limits announced each year by the Ministry of Trade, and to the Consumer Courts above those limits. For business Buyers, the courts and enforcement offices of İzmir have jurisdiction.

8. Effect

The agreement takes effect when the Buyer accepts it electronically at checkout. A copy is emailed to the Buyer and kept in the account.
